RESOLUTION Adoption of Revised Master Plan Revisions
WHEREAS, in 2009 the Town of Marcy adopted its current master plan which represented a comprehensive document featuring an examination of existing natural, economic and social conditions, public opinions, and a series of assumptions with regard to emerging development communities; and
WHEREAS, as a result of various changes in the region, including the continuing development of the SUNY-POLY Campus and Quad-C, the Town applied for, and received a grant from the New York State Energy Research and Development Authority (NYSERDA) through the Cleaner Greener Communities (CGC) Implementation Grant Program, which funds were used by the Town to undertake a smart growth update and implementation project regarding its 2009 master plan, so as to identify specific measures by which the Town can advance the goals of the CGC program in a manner that is consistent with Smart Growth principals; and
WHEREAS, in May of 2015, the Town retained the services of Environmental Design and Research D.P.C. to assist with review and development of revisions to the 2009 Master Plan; and
WHEREAS, the Town, through its administrative boards, including specifically, its Planning Board, worked with Environmental Design and Research, D.P.C. and Clarion Associates, and solicited public comment to develop proposed revisions to its master plan update; and
WHEREAS, on December 30, 2015, pursuant to a resolution of the Planning Board made the 14th day of December, 2015, the Planning Board formally presented to the Town Board for its review, a draft entitled “Town of Marcy, NY Master Plan Update” (hereinafter “Master Plan Update”) which is the result of a series of public meetings and Planning and Zoning Board meetings with the Project Steering Committee and municipal staff; and
WHEREAS, the Town Board conducted a public hearing on February 4th, 2016 at which time a presentation was made to the public by Environmental Design and Research, D.P.C. regarding the Master Plan Update, and at which meeting public comments were solicited from all interested persons concerning the proposed draft; and
WHEREAS, the Master Plan Update was referred to the Oneida County Department of Planning, for its review and comment pursuant to Section 239 of the General Municipal Law, and in accordance with the provisions of the State Environmental Quality Review Act, to all interested and/or involved agencies; and further, copies of the Master Plan Update were served upon all adjacent municipalities; and parties thought to be interested in the development of a revised Master Plan for the Town of Marcy; and
WHEREAS, the Town received, and the Planning Board reviewed, written comments received from the Oneida County Department of Planning, a local engineer, Alan Swierczek, dated January 29, a letter from Richard Laberge dated February 2nd, an e-mail dated February 4th from Beth Watts with the NYS Department of Transportation, a letter dated February 12th from James Bartkowiak of the Oneida County Department of Public Works, and comments via website dated February 15th from Joseph Koronowski and Matthew Frank Humphreys dated February 20th; and
WHEREAS, the Town Board fully considered all public comment and responses received, and reviewed the Environment Assessment Form as well as all other matters deemed relevant to the adoption of the revised master plan entitled “Master Plan Update”, including the written recommendation of the Planning Board dated February 23, 2016 and the suggested revisions noted therein;
NOW, THEREFORE, BE IT RESOLVED, that the requirements of the State Environmental Quality Review Act (SEQRA) have been met, and that consistent with the relevant social, economic and other essential considerations, the Board hereby finds the absence of any environmental significance to the formal adoption of the Master Plan Update dated December 30, 2015, and in connection therewith, hereby authorizes the Town Supervisor to execute a negative declaration in connection therewith; and
BE IT FURTHER RESOLVED, that the Town Board formally adopts the draft Master Plan Update dated December 30, 2015 as the official comprehensive plan for the Town of Marcy, subject to the following revisions recommended by the Planning Board:
1. Removal of all the Appendices except the Appendix F (to become Appendix A). The other appendices should be a separate supporting document, but not part of the officially adopted plan;
2. Refinement of the “West Side Campus” character area description to be more flexible for future development of areas near Rt. 291 and Paul Becker Road; and
3. Refinement of the “River Road Commercial Business” character area boundary to include all areas fronting on River Road between Cavanaugh Road and the railroad bridge.
