LOCAL LAW NO. 01/2006

A Local Law Entitled "A Local Law Increasing The Composition of the Board of Assessment Review From Three (3) Members to Five (5) Members In The Town Of Marcy, New York".

Section 1. Purpose. The Town Board of the Town of Marcy in an effort to provide a fair administrative review for taxpayers who feel their assessments are unequal, excessive or unlawful or that their property is misclassified hereby increases the composition of the Board of Assessment Review to five (5) members pursuant to Section 523 of the Real Property Tax Law.

Section 2. Terms. All of said members of said Board of Assessment Review shall serve for a period of five (5) years, except that out of the two (2) additional appointees, contained herein, one shall serve a one (1) two (2) year term initially and one (1) a four (4) year term initially.

Section 3. Powers. Said Board of Assessment Review shall perform all of the duties of a Board of Assessment Review as provided in Section 523 of the Real Property Tax Law.

Section 4. Severability. If this section, subsection, sentence, clause or phrase of this local law is, for any reason to be held invalid, such decision shall not affect the validity of the remaining portions of this local law.

Section 5. Effective Date. This Local Law shall take effect upon the filing with the Secretary of State.
